The NSW government is investigating whether Woolworths breached retail trading laws by sending staff into stores hours before opening time on Anzac Day to prepare for trade. A spokesman for NSW Treasurer and Minister for Industrial Relations, Gladys Berejiklian, said on Tuesday the Department of Industrial Relations was "pursuing the issue" following media reports on Monday that Woolworths' NSW supermarket staff had filled meat and deli counters, cooked roast chickens and baked bread hours before stores were allowed to open at 1pm.

Under NSW retail trading laws, retailers are not allowed to trade, accept deliveries or prepare for sale before 1pm on Anzac Day, unless they have an exemption.

Woolworths defended its activities, saying preparation was carried out by volunteer salaried managers, not team members employed under enterprise agreements, in line with the NSW regulations. However, Coles was furious because it had sought and was denied clearance to prep stores before 1pm. Retailers said the "ludicrous" situation highlighted the need for harmonisation of retail trading laws between the states and within states.

When the NSW government passed legislation to allow trading on Boxing Day, it sought changes to laws to allow stores to prepare for sale, but not to open, before 1pm on Anzac Day and on several other public holidays. However, this part of the bill was opposed by some parties and no changes were made.
